In the ongoing saga of the 2021 Meadowlands Pace Final where the harness racing three-year-old Charlies May won the race but was placed ninth by the judges, the New Jersey Racing Commission won over Don Tigers appeal of the race.
The Superior Court of NJ released its verdict in favor of the New Jersey Racing Commission on Tuesday, July 2.
“In the closing documents, the NJRC Executive Director rejected the ALJ’s credibility findings. The Executive Director recognized that ordinarily she would defer to the ALJ on this issue, but detailed why the ALJ’s credibility findings were arbitrary, capricious or unreasonable and not supported by sufficient, competent, and credible evidence in the record, namely the race videos.
We find no error in this determination. To the extent we have not addressed any of Tiger’s remaining arguments, we conclude they lack sufficient merit to warrant discussion in a written opinion.”
