Kentucky judge dismisses HISA constitutionality suit

Columbus, OH — A federal judge in Kentucky on Friday (June 3) dismissed a lawsuit brought by the State of Oklahoma and several other plaintiffs, including the United States Trotting Association, that challenged the constitutionality of the Horseracing Integrity and Safety Act (HISA).

Judge Joseph M. Hood of the United States District Court for the Eastern District of Kentucky held against the plaintiffs on their constitutional claims but ruled in the plaintiffs’ favor in regard to justiciability, confirming that the plaintiffs are proper parties to assert their constitutional claims in federal court.

If an appeal to Judge Hood’s decision is filed, it would be heard by the United States Court of Appeals for the Sixth Circuit, located in Cincinnati, Ohio.
